Terms of Service

By registering for, accessing, or using the Recruitarian platform (the "Platform") operated by Recruitarian LLC, you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, you must not use the Platform.

If you are accessing the Platform on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

You must be at least 18 years old to use the Platform. When creating an account, you agree to provide accurate, current, and complete information.

You are solely responsible for maintaining the confidentiality of your account credentials (managed via Clerk authentication) and for all activities that occur under your account. You must immediately notify Recruitarian LLC of any unauthorized use of your account.

Recruitarian provides AI-powered tools, including resume parsing, Candidate Match Scores, generated interview questions, and a Recruiter Copilot. These tools utilize Large Language Models (LLMs) to analyze text.

Informational Use Only: AI-generated outputs are probabilistic and provided for informational purposes to augment your hiring process. Recruitarian LLC does not guarantee the accuracy, completeness, or lack of bias in AI outputs.

Human Review Required: You agree that you will not use the Platform to automatically hire or reject candidates without meaningful human review. You remain solely responsible for the final hiring decisions.

You are exclusively responsible for ensuring that your use of the Platform, including how you evaluate candidates, complies with all applicable local, state, federal, and international employment laws.

This includes, but is not limited to, Equal Employment Opportunity (EEO) laws, anti-discrimination laws, and data privacy regulations regarding candidate data. Recruitarian LLC provides technological tools but assumes no responsibility for your compliance failures or discriminatory hiring practices.

You retain all rights to the data you upload, including job descriptions, recruiter notes, and candidate resumes ("Customer Content"). By uploading Customer Content, you grant Recruitarian LLC a secure, limited license to process and analyze this data solely to provide the services to you.

Recruitarian LLC retains all intellectual property rights to the Platform itself, including the underlying algorithms, codebase, UI/UX, and proprietary Match Score methodologies. You may not copy, reverse-engineer, or attempt to extract the source code of the Platform.

You agree not to engage in any of the following prohibited activities:

• Using the Platform to violate any employment, anti-discrimination, or privacy laws.
• Uploading resumes of individuals without the legal right to process their personal data.
• Attempting to bypass security measures, scrape data, or overload our infrastructure.
• Using the Platform to build a competitive product or service.
• Uploading malware, viruses, or malicious content within resume files or job descriptions.

Recruitarian LLC offers subscription-based access (managed via Dodo Payments). By subscribing, you agree to pay all applicable fees associated with your chosen plan.

Renewals: Subscriptions automatically renew at the end of each billing cycle (monthly or annually) unless you cancel prior to the renewal date. You can cancel your subscription at any time through the Billing portal on your Dashboard.

Changes: We reserve the right to change our pricing upon reasonable advance notice.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. RECRUITARIAN LLC EXPLICITLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Recruitarian LLC does not warrant that the Platform will be uninterrupted, secure, or error-free, nor that AI-generated candidate rankings are objectively correct or legally compliant.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL RECRUITARIAN LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM OR ANY HIRING DECISIONS MADE USING THE PLATFORM.

In no event shall Recruitarian LLC's aggregate liability exceed the total amount paid by you to Recruitarian LLC in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Recruitarian LLC and its affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your hiring decisions, your violation of employment laws, or your use of the Platform.

We reserve the right to suspend or terminate your account and access to the Platform at our sole discretion, without prior notice, if we believe you have violated these Terms, engaged in illegal activity, or if your payment method fails.

Upon termination, your right to use the Platform will immediately cease, and you remain liable for any outstanding fees.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Recruitarian LLC is registered (Wyoming, USA). Any dispute arising out of or relating to these Terms or the Platform shall be resolved exclusively through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
